A 31-year-old St. Francis woman is facing criminal vehicular homicide charges after she was allegedly using her phone and accelerating when she struck a bicyclist from behind and killed him, according to reporting from KSTP and the Star Tribune.
The bicyclist, 49-year-old Kelly Matthew Linder of Albert Lea, had been stopped at an Anoka County intersection when the woman hit him from behind at speeds between 45 and 53 miles an hour, throwing Linder to his death.
“If [the driver] had not been using her phone … and had maintained forward awareness, the crash would not have occurred,” the criminal complaint alleged. “There was ample time and space for [her] to slow and use the bypass lane to avoid hitting [Linder].”
According to the Star Tribune, the complaint says that the driver told law enforcement that she used her phone while driving, but had it in the center console and denied being on it at the time of the crash.
